4.1 Booking Process: When you make a Booking through our Services, you are entering into a contract with the Property Partner, not with Staytica. We act as an intermediary between you and the Property Partner.
4.2 Pricing and Payments: All prices displayed on our Services include applicable taxes unless stated otherwise. Payment methods and conditions are specified during the booking process.
4.3 Booking Confirmation: Your Booking is confirmed once you receive a booking confirmation email from us. The booking confirmation will include the details of your reservation and the Property Partner's policies.
5.1 Cancellation Policy: Cancellation policies vary by Property Partner and are clearly displayed during the booking process. Please review the cancellation policy carefully before completing your Booking.
5.2 Modification Requests: If you wish to modify your Booking, you may do so subject to the Property Partner's policies and availability. Modification requests may incur additional charges.
5.3 Refunds: Refunds are processed according to the Property Partner's cancellation policy. We will make reasonable efforts to process refunds promptly, but the timing of the refund to your account depends on your payment method and financial institution.
When using our Services, you agree not to:
7.1 Our Content: All content on our Services, including but not limited to text, graphics, logos, images, software, and audio and video clips, is owned by or licensed to Staytica and is protected by copyright, trademark, and other intellectual property laws.
7.2 Limited License: We grant you a limited, non-exclusive, non-transferable license to access and use our Services for personal, non-commercial purposes.
7.3 Restrictions: You may not copy, modify, distribute, sell, or lease any part of our Services without our prior written consent.
Our Services are provided on an "as is" and "as available" basis. We make no warranties, expressed or implied, regarding the operation or availability of our Services.
We do not guarantee that the information on our Services is accurate, complete, or up-to-date. Property Partners are responsible for the accuracy of their property descriptions, amenities, and policies.
To the maximum extent permitted by law, Staytica shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our Services.
In no event shall our total liability to you for all claims arising from or related to your use of our Services exceed the amount paid by you to us during the six months preceding the event giving rise to the liability.
You agree to indemnify and hold harmless Staytica, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to your use of our Services or your violation of these Terms and Conditions.
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principles.
Any dispute arising out of or related to these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts located in San Francisco County, California.
We reserve the right to modify these Terms and Conditions at any time. If we make material changes, we will notify you by email or by posting a notice on our website prior to the changes becoming effective.
